This privacy policy ("Privacy Policy") has been drafted and published in accordance with the Information Technology Act, 2000, the Information Technology (Amendment) Act, 2008, and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, of the Republic of India.

Dadana Technologies Private Limited (here in after referred to as "We", "Us", "Company" or "Our") is concerned about the privacy of the users (here in after referred to as "You", "Your" or "User") of its website located at www.moonlyte.com ("Website") and mobile application available on AppStore and Play Store ( "App"). Where the context so requires, the Website and the App shall be collectively referred to as the "Platform" . This Privacy Policy describes our policies and procedures for collection, use, storage, processing, disclosure and protection of any information, including, but not limited to, business, sensitive or personal information provided by You while using the platform.

This policy constitutes a legal agreement between You, as the user of the Platform, and the Company, as the owner of the platform. You must be a natural person who is at least 18 years of age. If you are less than 18 years of age, please read through this Privacy Policy with your parent or legal guardian, and in such a case this Privacy Policy shall be deemed to be a contract between the Company and your legal guardian or parent and to the extent permissible under applicable laws, enforceable against You.

By visiting or accessing the platform and voluntarily providing us with information (personal and/ or non- personal), You are consenting to Our use of it in accordance with this Privacy Policy. This Privacy Policy does not apply to third-party platforms/ applications that are connected via links to the Platform. If You do not agree with the terms and conditions of this Privacy Policy, please do not proceed further to use and access this Platform.

Your use of the Platform will be governed by this Privacy Policy as applicable to the Platform together with all policies, notices, guidelines, disclaimers that are published and shared with You from time to time which are incorporated herein by way of reference including but not limited to Terms of Use (as available at policies.moonlyte.com) and such other terms as may be applicable to You in Your capacity as a user of the Platform. In order to consider Your application for the Programme, We may collect a variety of Personal Information, including but not limited to, Your name, postal address, phone number, email address, contact preferences, government issued identification cards, educational certificates, background verification reports, etc. We may collect any other information that We are required to collect as per specific mandate from any bank, payment gateway or as required under applicable law.
    The Personal Information is collected from you in a voluntary fashion when You provide your credentials on the Platform. You may choose to not provide such Personal Information to Us. However, it is clarified that Personal Information may also contain any chats, texts, videos, audios, files and/or share screen facilities which are used or shared by You, either alone or in conjunction with any other user of the Platform and any such chats, texts, videos, audios, files and/or share screen facilities may be recorded and/or stored by the Platform.
    You are required to ensure that Your contact information and preferences are accurate, complete and up to date by logging into Your Account (as defined under the Terms of Use). We shall also provide You with the opportunity to request correction of data relating to Your Personal Information if the same is inaccurate or delete the data. Further, We may decline to process requests which We find to be contrary to the terms laid down under this Privacy Policy, the Terms of Use or any applicable laws, or which require disproportionate technical effort, jeopardize the privacy of others or are extremely impractical.

  2. To create Your Account and to support You with any services related to Your Account.
  3. Assess Your credentials including but not limited to educational qualifications, work experience as specified in Your application for shortlisting or selection for the Platform.
  4. To conduct any background checks, if required, as the Company may deem fit.
  5. To update You about the status of Your application and provide You any agreed assistance or support with respect to the Platform.
  6. To verify whether you are entitled to access and use the Platform or any the products and services made available through the Platform.
  7. To provide any value-added services, either through itself or through a third party service provider in the Platform.
  8. To prevent any abuse, trolling or other acts which may be contrary to law or detrimental to the interest of any other user of the Platform or person.
  9. To prevent any illegal or unlawful acts or any misuse of the Platform by You or any other user of, or by using, the Platform.
  10. To update You upon the development and news in relation to the Platform.
  11. To collect any monies owed by You to any other person using the Platform or to the Company.
  12. Provide You updates for any events conducted by the Company.
  13. Conduct research and analysis to detect, prevent, mitigate and investigate fraudulent or illegal activities on the Platform.
  14. Analyze how the Platform is used, diagnose service or technical problems, maintain security.
  15. To help You efficiently access the Platform.
  16. Monitor aggregate metrics such as total number of viewers, visitors, traffic, and demographic patterns.
  17. To notify You regarding your account, to troubleshoot problems with Your account, to resolve a dispute, to confirm Your identity in order to ensure that You are eligible to Use the Platform.
  18. For advertising and marketing communications. We may also share Non-Personal Information with third parties such as, Our advertisers, sponsors, investors, advisors, business partners.
  19. To carry out Our obligations and to process transactions arising from any contracts entered into between You and Us or You and any other user of the Platform.
  20. To notify You about changes on the Platform.

Not withstanding anything contained in this Privacy Policy or elsewhere, the Company shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below) or any act or omission attributable to You or any person claiming on Your behalf. Information we share
  1. Company may disclose any information provided by You on the Platform as may be deemed to be necessary or appropriate:
    1. Under applicable law, including laws outside Your country of residence.
    2. To comply with legal process.
    3. To respond to requests from public and government authorities including public and government authorities outside Your country of residence.
    4. To enforce Our Terms of Use.
    5. To protect Our operations or those of any of our affiliates.

CHANGE IN PRIVACY POLICY

Company may update this Privacy Policy at any time, with or without advance notice. In the event there are significant changes in the way the Company treats Your Personal Information, Company will display a notice on the Platform or send You an email, as provided for above. Unless stated otherwise, this Privacy Policy applies to all information that Company has about You and Your account. Notwithstanding the above, Company shall not be required to notify You of any changes made to the Privacy Policy. If You use the Platform after notice of changes have been sent to You or published on the Platform, Your continued use of the Platform shall mean Your deemed consent to the changed practices.

CHOICE/OPT-OUT/DELETION/CORRECTION

  1. Company provides all its users with the opportunity to opt-out of receiving non-essential communications from us or on behalf of our partners after setting up an Account.
  2. If You want to remove Your contact information from all Our lists and newsletters, please write to us at unsubscribe@moonlyte.com with “unsubscribe” as the subject or any button provided on the Platform, as the case may be.
  3. If You wish to have the information or data that you have provided to the Company deleted, You can always do so by sending a request to us on the e-mail id. You may note that correction or deletion of certain information or data may lead to cancellation of your registration with the Platform or your access to certain features of the Platform. You also agree and acknowledge that certain data or information cannot be corrected or deleted or prohibited to be deleted as required under any applicable law, law enforcement requests or under any judicial proceedings. Any information that is sought to be deleted, whether upon deactivation of Your account on the Platform or otherwise, shall be deleted from the user interface of the Platform but may be retained on the servers of the Company for such period as may be required under applicable laws, Terms of Use or as per the policy of the Company or any third-party vendor engaged by the Company. You acknowledge and agree that the Company and/or any third-party vendor engaged and authorised by the Company shall be entitled to retain such information to the extent required under this clause and the Company disclaims any liability or obligation not specifically agreed hereunder with respect to such information. You also agree that any aggregated information or data based on the analysis or benchmarking activity undertaken by the Company, either manually or through related algorithms, shall be the sole property of the Company and the Company shall neither have the obligation to delete it or provide such aggregated information or data to You.

EXCLUSION

This Privacy Policy does not apply to any information other than such information collected by the Company through the Platform. This Privacy Policy shall not apply to any unsolicited information You provide Us through this Platform or through any other means. This includes, but is not limited to, information posted to any public areas of the Platform. All such unsolicited information shall be deemed to be non-confidential and the Company shall be free to use, process or disclose such unsolicited information without any limitations. We make no representation that the content contained on the Platform is appropriate or to be used or accessed outside of the Republic of India. The Company’s responsibility with respect to such information shall be as per the laws of Republic of India. If You use or access the Platform from outside the Republic of India, You do so at Your own risk and are responsible for compliance with the laws of such jurisdiction.

SEVERABILITY

We have taken every effort to ensure that this Privacy Policy adheres with the applicable laws. The invalidity or unenforceability of any part of this Policy shall not prejudice or affect the validity or enforceability of the remainder of this Privacy Policy. This Privacy Policy does not apply to any information other than the information collected by the Company through the Platform. This Privacy Policy shall be inapplicable to any unsolicited information You provide us through this Platform or through any other means. This includes, but is not limited to, information posted in any public areas of the Platform. All unsolicited information shall be deemed to be non-confidential and the Company shall be free to use and/ or disclose such unsolicited information without any limitations.

WAIVER

Any rights or remedies under this Privacy Policies may be waived only in writing. Delay in exercising or non-exercise of any such right or remedy does not constitute a waiver of that right or remedy, or any other right or remedy.

GOVERNING LAW AND JURISDICTION

This Privacy Policy are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with the use of the Platform or this Privacy Policy shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
